In the main department of investigation of particularly important cases of the RA Investigative Committee, a number of important circumstances of the cases of fraud and document falsification of the acquisition of real estate owned by a number of citizens in the former area of North Avenue were revealed.
The investigation revealed that H.A., the director of the real estate appraisal company SP, helped A.K. of 12 owners in particularly large amounts for intentional fraud and breach of trust; stole real estate and funds totaling AMD 666,765,500, as well as obtained obviously false official documents granting rights.
Thus, in 2001 On July 16, the Government of the Republic of Armenia approved the alienation zone of immovable properties (land, buildings and constructions) located in the section of Yerevan's North Avenue, taken for the needs of the state, with an area of 82,700 square meters, in which, among others, of properties, the real estates of a number of addresses located in the adjacent area of Abovyan-Nalbandian-Arami streets in Yerevan were also included and subject to realization.
By the same decision, the mayor of Yerevan was authorized to organize and carry out real estate evaluation works in the subject area within a two-month period through the relevant licensed organizations.
At the same time, in order to solve the problems related to the purchase and taking of the plots of land and real estate located in the development zone of Yerevan's North Avenue, and providing compensation to legal entities, the Government of the Republic of Armenia, in 2001 The October decision approved the procedure for formulating and implementing a price offer to citizens and legal entities in connection with the purchase and acquisition of the plots of land and real estate located in the alienation zone of North Avenue of Yerevan, which also established that the compensation for the immovable property to be bought, taken, in addition to money, can also be made with other property, in the form of land, residential or non-residential buildings, or by providing the right of ownership of the immovable property, with its value offset in the compensation price.

The investigation established that H.A., assisting in the theft of the above-mentioned particularly large real estates and funds belonging to a number of persons under the right of ownership of A.K. by means of deception and abuse of trust, concluded contracts of close relations with him. belonging to A.K. and by the latter with the managed LLC, as a result of which it was agreed to value the mentioned real estates at prices much lower than the real market values and to prepare false valuation reports regarding them, as a result of which A. K. was given the opportunity to purchase these real estates at a price much lower than the real values.
In particular, between the director of the evaluator LLC and the director of the developer LLC in 2005. in September and 2007 in April, two separate contracts for the provision of real estate valuation services were signed, according to which the executor was obliged to carry out the valuation of the real estates in the area of Abovyan, Aram and Nalbandian streets, adjacent to North Avenue, as indicated in the master plan, which is an integral part of the said contract.
Then, on the basis of the mentioned contracts and the relevant letters addressed to him by the developer, the director of the appraisal company instructed the employee to make false reports on the determination and evaluation of real estate values, in order to realize them by the director of the developer company and to fraudulently steal the particularly large properties belonging to the owners of the above-mentioned addresses.
The employee of the SP company prepared and approved with his signature a reservation of rights, false in content, that is, a real estate valuation report that is several times cheaper than the market, regarding 6 immovable properties belonging to persons with the right of ownership and taken for the needs of the state, included in the boundaries of the expropriation zone and subject to sale. and: provide it to the director of the company, which the latter's head has certified with his signature, approved with the seal of the LLC, and hand-delivered to the director of the construction company.
In this way, the method of disbursing funds has facilitated the latter's particularly large-scale fraud.
Then, referring to the fake appraisal report, the director of the development company offered the owners a price several times lower than the real value as the purchase price of the real estate they owned.
In separate cases, the director of the development company has fraudulently convinced the owners to sign a settlement agreement with him, offering a slightly higher amount than the previously offered amount, as well as areas of various public surfaces above the zero mark of the apartment building to be built by the LLC, from the 1st floor area. , but did not fulfill the agreements reached.
Based on the obtained sufficient facts, a public criminal prosecution was initiated against the director of the SP company engaged in real estate appraisal under Article 38-178, Part 3, Clause 1 of the former Criminal Code of the Republic of Armenia (corresponds to Article 46-255 of the current Criminal Code of the Republic of Armenia). to point 3 of part 3) and part 1 of article 325 (corresponds to the current criminal code of the Republic of Armenia on Article 457, Part 1 of the Code).
And a public criminal prosecution was initiated against the director of the developing SP company under Article 178, Part 3, Clause 1 of the former Criminal Code of the Republic of Armenia (corresponds to Article 255, Part 3, Clause 3 of the current Criminal Code of the Republic of Armenia) and Article 325 (corresponds to part 1 of article 457 of the current Criminal Code of RA).
In the course of the preliminary investigation, the total damage of 666,765,500 AMD was fully recovered.
