A coup d'état. Orbelyan on the decision regarding the Declaration of Independence


The recent decision of the Constitutional Court that the declaration of RA independence is not part of the Constitution and has no legal force is a coup d'état. Lawyer Aram Orbelyan made this statement in the RA National Assembly. It should be noted that hearings are underway in the National Assembly on the draft statement "On the absurd relevance of the Declaration of Independence of Armenia". Let us remind you that a few days ago, on September 26, the Constitutional Court decided that the national goals established in the RA Declaration of Independence, which were not included in the actual text of the Constitution, have no legal force. This circumstance has become a reason for wide discussions, a number of experts and oppositionists believe that this section was included in the decision of the Supreme Court for the benefit of Azerbaijan.

"Did the Constitutional Court have the right to make such a decision, and was that decision unjustified? My answer is no."

The "constitutional body of the Republic of Armenia" is carrying out a process that it has no right to, and it is called a coup d'état. It is a criminal act punishable by at least 5-6 articles of the Criminal Code of the Republic of Armenia, possibly a dozen as well, which should be assessed accordingly," said Orbelyan.

The human rights defender emphasized that the constitutional order should be restored, not to say that it has not been overthrown. Orbelyan mentioned that since the fall of 2018, attempts have been made to carry out coup d'états regularly, first of all, the capture of the National Assembly, then, already with the 2020 changes to the courts, the capture of the Constitutional Court. "Now an attempt is being made to undermine the constitutional foundations, that is, the Declaration of Independence, and then they will try to abolish the Constitution itself, and then they will decide that it is necessary to give the Prime Minister extraordinary powers," Orbelyan emphasized.
