The Ministry of Territorial Administration and Infrastructure proposes to make amendments and supplements to the Government's Resolution No. 834-N of June 6, 2024.
The Civil Aviation Committee, in accordance with Part 2 of Article 7 of the Law "On Aviation", is a state authorized body in the field of regulation of the air transport sector, civil aviation and non-military state aviation activities, air traffic services, aviation safety, flight safety, as well as regulation of the safety and security of ground facilities operated and services provided in the aviation sector, and supervision of aviation services and aviation infrastructure operating in Armenia.
Along with the implementation of its regulatory and supervisory functions, the Committee, in accordance with the Law "On Aviation", currently also provides a number of services, for which, however, no state duty has been established (it was established for only one service, namely "symbolic").
As a result, by the Law "On Amendments to the Law "On State Duty" HO-218-N of May 2, 2024, a state duty has already been established for services provided in the field of civil aviation, for which the Committee also studied international experience.
It showed that similar services are provided by aviation authorities in a number of countries around the world on a paid basis.
In particular, the experience of Georgia, Latvia, Singapore and a number of other countries was studied. The draft proposes to establish a procedure for collecting the state duty established by law,as well as to take appropriate preventive measures in case of non-payment of the established annual fee.
It is also necessary to clarify the procedure for the air transportation of cargo considered dangerous, as provided for in Chapter 4 of the Procedure approved by Decision N-834-N.
Aircraft operators registered in the Republic of Armenia shall obtain a permit for the air transportation of dangerous cargo in accordance with Form N 1 of the Procedure.
Chapter 4 of the Procedure refers to the process of appropriate packaging and documentation for the air transportation of dangerous cargo, based on applications sent to the authorized body by aircraft operators registered in Armenia or their cargo transportation agents.
The implementation of the appropriate packaging and documentation process for the air transportation of dangerous cargo specified in the application requires the consent of the authorized body.
It provides consent to carry out the transportation specified in the application, but not a permit. He examines the information submitted with the application: the relevant notes in the special operating provisions of the airline performing the transportation, the nature of the dangerous goods being transported, the four-digit code assigned to the dangerous goods by the UN, the quantity of the cargo by unit of measurement, the total number of places, the type of packaging, the direction of transportation, the day, the flight number, and gives consent to carry out the transportation.
