The decision to terminate the criminal prosecution against Misha Gyurjian, who is accused of committing criminal acts under Article 255, Part 2, Clauses 1, 3, and Article 457, Part 2 of the RA Criminal Code, in the criminal proceedings under investigation by the RA Investigative Committee, is unreasonable and obviously gave rise to politicized speculations.
Considering this circumstance as unacceptable, the RA Investigative Committee considers it necessary to clarify the following: According to the RA government's decision No. 1614 of October 10, 2024, among other regulations, it was established that as a result of forced displacement from Nagorno Karabakh, which appeared in the territory of the RA and is not considered private property: until 2017 The state registration of the right of ownership of production light passenger cars (except for the cases specified by the legislation) is carried out by persons who have appeared in the RA territory as a result of forced displacement from Nagorno Karabakh, who have received (possessed) RA citizenship, or who have received (possessed) RA citizenship or the RA Government's 2023. in the name of the persons who actually own or use the means of transport taken under temporary protection in the Republic of Armenia in accordance with Clause 1 of the Resolution N1864-N of October 26.
In the criminal proceedings, it was substantiated that during the period of registering the car in his name, the accused submitted references and decisions that did not correspond to reality or did not exist, and in this way he illegally and gratuitously made the said car his own. However, under the legal regulations of the above-mentioned RA Government decision improving the legal status of the actual person, the public danger of the act committed by the accused has significantly decreased and based on the provisions of Article 16, Part 2 of the RA Criminal Code, it cannot be considered a crime.
Taking into account the above-mentioned justifications, the body conducting the proceedings submitted a motion to the supervising prosecutor to stop the public criminal prosecution against the accused, which was granted.
