The preliminary investigation of the criminal proceedings initiated in connection with the case of materially benefiting the persons in order to participate in the election has been completed in the main department of investigation of particularly important cases of the RA Investigative Committee.
As a result of the investigative and evidentiary actions, it was found that 35-year-old H.Sh. On May 26, in Yerevan's Republic Square, in order to ensure a large crowd at the gathering organized by the "Tavush for the Motherland" movement, to present demands on behalf of a large number of people during the gathering, in order to ensure the physical presence of the people actually living in the Vardenis community of Gegharkunik region, he tried to materially interest these people through his relative. promising to give each of them 6000-8000 AMD, fuel, and to participate in the gathering with overnight accommodation in this case, also food and drinks, about which he reached an agreement with the mentioned relative.
The latter, however, initially did not intend to carry out actions aimed at attracting people to participate in the gathering, as a result of which, as well as due to the detection by law enforcement agencies, the crime organized by the 35-year-old man was not carried out due to circumstances beyond his will.
Based on the obtained sufficient facts H. A final charge was presented to Sh., under Part 2 of Article 43-236 of the RA Criminal Code.
According to the court's decision, house arrest was applied to him as a preventive measure, which was later replaced by "administrative control" restriction.
The preliminary investigation was completed and the materials of the proceedings were sent to the court with an indictment. Criminal prosecution was also initiated against the mentioned person under Article 255, Part 3, Clause 3 and Article 457, Part 1 of the RA Criminal Code.
Although the preliminary investigation proved that during the period of registration of the relevant movable property in his name, the accused submitted references, decisions that did not correspond to reality or did not exist and thus made it his own gratuitously and illegally, but considering that the RA Government, the actual person Under the conditions of the decision No. 1614-N of October 10, 2024, improving the legal situation, the public danger of the act committed by the accused has significantly decreased, RA Criminal Based on the provisions of Part 2 of Article 16 of the Code, a motion was submitted by the body conducting the proceedings to the supervising prosecutor to stop the public criminal prosecution against the accused in this regard, which was granted.
