"Zhoghovurd" daily newspaper applied to the State Revenue Committee with an official request to find out the history of a large batch of paraffin imported to the Republic of Armenia, which, according to various reports, was confiscated during the tenure of the former chairman of the SRC Rustam Badasyan.
In particular, the editors tried to find out a number of key questions: when and by whom the given paraffin was imported to Armenia, what volume was it, which company was the importer, on what basis it was confiscated, in the framework of administrative proceedings, criminal case or other customs violation.
"Zhoghovurd" daily was also interested in: • by what decision and when was the confiscation carried out, • where and under what conditions was the paraffin stored? • what was its future fate: sale by auction, destruction, return to the importer or another decision?
If a sale was made, we also asked for the date of sale, price and buyer's information. And if the product was destroyed, the information about the act of destruction.
In addition, another important circumstance was highlighted in the survey: whether criminal proceedings have been initiated in relation to the given case, and if so, what is its course, as well as whether funds have been entered into the state budget as a result of the sale of the given batch. However, the State Revenue Committee, as a matter of fact, refused to answer the questions.
The SRC informed "Zhoghovurd" daily newspaper that according to part 2 of Article 356 of the EAEU Customs Code, customs bodies and their officials do not have the right to publish or transmit information that may contain state, commercial, tax, banking or other secrets protected by law.
According to the clarification of the SRC, such information cannot be provided, except for the cases provided for by the same code or international agreements.
In other words, the state body did not publish either the data of the importer, the legal basis of the confiscation, or any information regarding the further fate of the product.
Meanwhile, the issue is a matter of public interest. it refers to the fate of a large batch of goods imported to Armenia, in case of which, in case of sale or destruction, theoretically, considerable sums could be entered into the state budget.
