The government approved the package of drafts of the Law "On Amendments to the Law on State Control Service" and related laws.
The package of legislative drafts on making amendments and additions to the Law on "State Control Service" and related laws, developed and put into circulation, was approved today at the Government session.
The development of the project was conditioned by the need to eliminate a number of procedural problems that appeared during the more than 6 years of operation of the current law, to clarify control tools and to provide more effective solutions to the problems posed at the current stage of the establishment of the Service.
In general, the planned new legal regulations will create wider opportunities for recording cases of alleged corruption offenses discovered as a result of the Service's activities. Within the framework of the exercise of supervisory powers reserved to the RA Prime Minister, the supervisory processes for the legality and effectiveness of the management of state funds will be clarified, as well as the detection, prevention and recorded facts of possible abuses and violations. in order to decide what to do next.
According to the draft, the function of monitoring the implementation of the RA state budget by the RA Ministry of Finance will be assigned to the RA State Control Service.
The supervisory powers defined by the current law needed to be further clarified, which has already been improved in the draft law, as well as the definitions of the separate powers of the Service concepts and definitions have been clarified, as well as the definitions of the Service's powers, the control powers of the Service - studies and monitoring implementation procedures have been brought into the field of more general enforcement.
During the exercise of control powers, in order to prevent and counteract possible cases of creating obstacles to the activity of the Service, legislative guarantees were established by the project, providing for administrative responsibility for these subjects.
Within the scope of the service's powers, additional control tools have been planned in order to increase the effectiveness of control over the legality of subsidies, subsidies or endowments provided to local self-government bodies. Public procurements carried out in local self-government bodies and municipal institutions will also be kept are also the legal bases for the adoption of a number of orders adopted by the head of the Service, the procedures for receiving and processing data containing certain secrets in individual cases have been regulated.
The draft law "On Amendments to the Law on State Control Service" and the package of related draft laws will be submitted to the head committee of the National Assembly after approval by the Government, and after approval, will be included in the agenda of the plenary session of the parliament.
