The Ministry of Justice proposes to make an addition to the decision of the government of April 13, 2023 N 543-N. According to Article 4, Part 1, Clause 4 of the Law "On Penitentiary Service", one of the main tasks of the Penitentiary Service is the protection of penitentiary institutions, the transportation of convicts and detainees serving sentences in the form of deprivation of liberty. In accordance with Article 25.1, Part 1, Clause 3 of the same law, the Penitentiary Service organizes the protection of penitentiary institutions, the transportation of convicts and detained persons serving a sentence in the form of deprivation of liberty. The internal regulation of penal institutions of the Ministry of Justice was approved by the decision No. 543, which is aimed at ensuring the completeness of the order and conditions of execution of the punishments related to detention and deprivation of liberty, except for detention in the disciplinary battalion and short-term imprisonment assigned to servicemen, in penal institutions. However, the relations related to transportation and escorting of convicts serving a sentence of deprivation of liberty and those detained in cases defined by legislation are not regulated by the regulations. The mentioned relations have been regulated to a certain extent by the Minister of Justice, "On Approving the Procedures of the Structured Units of the Penitentiary Service of the RA Ministry of Justice" (2009 No. 311-N, Appendix 12) and "On Approving the Procedures of the Structured Units of the Protection of the Penitentiary Service of the RA Ministry of Justice" ( 2011. 195-N) in the relevant orders. However, during the transportation of convicts and detainees serving sentences of deprivation of liberty, the units carrying out the function of escorts of the penitentiary service are in certain relationships with other state bodies, as well as officials, therefore, there is a need to define more comprehensive regulations in the internal regulations of the penitentiary institutions subject to approval by the government's decision. With the adoption of the project, the functions of the accompanying units of the penal service of the MoH will be specified, and it is also expected that the penal service will establish more comprehensive regulations regarding the relations arising from the transportation of convicts and detained persons.
