If the NSS report contains a state secret, on what basis did Pashinyan share it with the CP members? Chalabyan filed a crime report


Avetik Chalabyan, the representative of "Hayakve" initiative, presented a report about the crime. In particular, he wrote on his Facebook page:

"On December 4, speaking from the podium of the National Assembly, Prime Minister Nikol Pashinyan, among a number of other self-confessed testimonies, gave a very important testimony regarding the unprecedented act he committed.

Answering the question of MP Agnesa Khamoyan, he admitted that he allegedly received a report from the NSS about the data on the phone of MP Hovik Aghazaryan, which apparently contained a leak of state secrets, after which he shared that data with the Department of Public Security, on the basis of which it made a decision. Remove Hovik Aghazaryan from the party.

In this connection, I have several questions:

a) if the NSS report contains data containing state secrets, on what basis did Nikol Pashinyan share those data with the members of the CP Department, at least some of whom do not have the appropriate permission to deal with state secrets, and is this not in itself a leak of state secrets by an official? by the person.

b) if the information contained in the NSS report was obtained in the context of pre-investigation activities, does not providing them to persons unrelated to the pre-investigation, such as the Prime Minister, members of the CP Department, constitute a violation of the secrecy of the pre-investigation?

c) if Hovik Aghazaryan is a deputy of the Republic of Armenia, and the National Assembly has not yet removed his parliamentary immunity, is the Investigative Committee authorized to conduct investigative actions against him, in particular, to confiscate his phone and extract personal confidential data from him?

d) if no state secrets were contained in all this, but it is only a matter of leaks regarding the discussions of the CP Department, on what basis does the National Security Service intervene in this matter? And on the contrary, if there really is a leak of state secrets, where did that information reach Hovik Aghazaryan, who provided it to him?

This list of issues can be continued for a long time, but it is obvious that this incident clearly reveals the entire level of lawlessness and legal chaos in the Armenian government system. This is inherent in dictatorial states, where there is no division of state and party bodies, executive. between the legislature and the judiciary, where law enforcement agencies obey the dictator's orders rather than the law.

The end of such dictatorial powers is also very predictable, and the incident with Hovik Aghazaryan shows that it is coming irreversibly.

Until then, I suggest the Prosecutor General of RA not to wait for that beautiful day, to accept this post of mine as a report about a crime, and to initiate criminal proceedings to answer all these questions. If this Prosecutor General does not do it for reasons that are understandable to all of us, I suggest the remaining prosecutors in the system, who are still loyal to their oath to serve the RA Constitution and laws, to do it for him, they have the right to do so.

I am ready to pursue that one wonderful day and help restore our citizens' faith in law and legitimacy."
