The Human Rights Defender considers the project to pass a military service for a short period of time


Human Rights Defender Anahit Manasyan considers the settings of the draft laws, which are proposed by paying 18 or 24 million drams, to go to the military for 4 or 1 month, respectively. The Defender's Office has recently received many alarms from citizens about the above proposals.


Design settings can create a serious social stratification due to the property of the people, being a violation of the principle of non-discrimination.


At the same time, the citizens who are able to pay 24 or 18 million drams, and the citizens who cannot pay this amount must be made for a longer period of time, and 24 months. As a result, it turns out that the people in the same status are differentiated, and the substantiation of the project does not indicate that such a difference has the objective justification and a goal that meet human rights standards.


According to the proposed regulation, it turns out that a particular group of servicemen is manifested in a more favorable attitude (service life) than other servicemen who did not pay the money. Serving for less than the amount will lead to unjust distribution of constitutional and legislative obligation. Socially secured servicemen will be given the opportunity to travel to a shorter period, and the servicemen who do not have the set amount will serve for a longer period of time.


From the point of view of social justice, such an approach cannot be considered acceptable. The servicemen must be free from discrimination on human rights and freedoms. Moreover, it is inadmissible to provide certain privileges to individuals only by property, in the case of having 18 or 24 million drams.


The settings proposed by the project also contain risks in terms of providing strong discipline in the army.


It is unequivocally difficult to imagine human rights protection and promotion in the army.


In this case, the question arises, whether the risks have been assessed as a strong and high level of discipline among the servicemen, which is to receive a privilege for paying only to pay for others. Will it not lead to the sympathetic conflict between the soldiers and the deepening of conflicts and non-chartered relations?


The Human Rights Defender suggests considering the issue of international obligations undertaken by the Constitutional and State, as well as to carry out wider public discussions on the proposed design settings.


Moreover, the Defender proposes to resolve the issues presented in the grounds by the state with other balanced means, the state's security and the right ratio of human rights.


The Defender of all the concerns about the projects will be more detailed to the competent state bodies.
