It has been recorded many times that Karen Andreasyan, as a politician who did not meet the criteria for holding the position of a member of the Supreme Judicial Council, was guided by political and personal motives throughout his tenure, violating the rule of law and the provisions and principles of the Constitution.
While holding the position of the President of the Central Committee of the Republic of Azerbaijan, Karen Andreasyan regularly carried out illegal actions aimed at limiting the independence of judges and the judiciary. Among them are, in particular:
Bringing judges to justice through illegal disciplinary proceedings agreed with the financial partner, the Minister of Justice, and spreading the chilling effect.
Instilling an atmosphere of demoralization with arbitrariness and injustices in the process of appointment and promotion of judges,
Interference in the activities of independent bodies of judicial power management and attempts to limit their powers,
Violation of the Constitutional norms by the normative legal acts adopted by the Central Bank of Ukraine, aimed at establishing "pyramidal governance" limiting the independence of judges under the guise of work discipline and case deadlines,
Self-interested legislative change initiatives with the Minister,
Issuing illegal instructions, organizing illegal elections and interfering in the electoral processes of the judicial members of the SC.
Organization of media attacks against judges with state resources,
Regularly engaging in self-promotion at the expense of the authority and resources of the judiciary,
The wastage of financial resources of the judiciary, especially large sums of money.
With these and many other actions, Andreasyan deliberately violated the independence of judges and undermined the institutional foundations of the judiciary. Regularly carried out such actions have significantly limited the rights of judges, weakened the independence of the judiciary and public trust in justice.
Appropriate assessments of the consequences caused by the mentioned actions will still be reflected in the decisions of the courts, including international ones.
Nevertheless, on November 18 of this year, along with the Facebook post of the head of the executive power, a number of law enforcement officials, asking them to vacate their positions, Karen Andreasyan immediately published the text of her resignation, implying that it is related to a series of political dismissals and that she is stepping forward. resigning.
Although a short time ago, on October 1, 2024, in connection with the resignation of the Minister of Justice, Karen Andreasyan, the press spokesperson of Karen Andreasyan issued an official statement, stating that the resignation of any member of the government and political processes cannot affect the President of the Central Committee of the Republic of Kazakhstan and he will serve until October 2027. 6 o'clock
On October 22, 2024, the Prime Minister of the Republic of Armenia clarified in an interview with the public television company that he personally asked Karen Andreasyan to resign from the position of the President of the Central Committee of the Republic of Armenia, which was fulfilled.
Although the fact that Karen Andreasyan and the members of the Central Judicial Council are under the direct influence of the political power has not been disputed in the past, it should be noted that the Supreme Judicial Council or any individual member has not had the courage to make any assessment until now, continuing to deepen the fact that they are under the influence of the executive. and consistent public perception.
Thus, the inability or lack of desire of the current members of the Supreme Judicial Council, who have assumed the mission of guaranteeing the independence of the judiciary under the Constitution, to express any position even to dispel public perception, undisguised and approved inadmissible interferences in the activities of the judiciary, in relation to restoring the authority of the judiciary, being especially concerned about the position of Karen Andreasyan and processes aimed at occupying the chair.
