The “Zhoghovurd” daily writes: “According to information received by the “Zhoghovurd” daily, investigators and prosecutors who worked in the law enforcement system of the Republic of Artsakh and who are currently working in the law enforcement system of the Republic of Armenia are faced with a fact.
The fact is that citizens who have worked as prosecutors and investigators in the Prosecutor’s Office and the Investigative Committee for 20 or more years, who have worked in the Investigative Committee or the Prosecutor’s Office of the Republic of Armenia after the evacuation in 2023, have been accepted for work and are holding office, taking into account the work experience of these persons. However, these days they have found themselves in uncertainty.
The fact is that investigators and prosecutors do not know whether they have the right to receive a pension if they have worked for a period of 20 or more years or not, whether the years of work as prosecutors and investigators in Artsakh will be counted as professional experience or not.
Let us note that Article 9 of the RA Law “ON ACTIVITY SECURITY, SERVICE AND SOCIAL GUARANTEES OF OFFICIALS” states that the period of professional work experience includes the period of working as a prosecutor, investigator, employee of the Special Investigation Service in the Republic of Armenia, as a prosecutor and investigator in the USSR Prosecutor’s Office system, the period of holding the position of a judge in the Republic of Armenia and the USSR, as well as the period of compulsory military service.
In fact, for the purposes of this regulation, only the professional experience of a prosecutor and investigator in the Republic of Armenia is subject to calculation.
In the presence of these legal regulations, how should the social guarantees of our compatriots from Artsakh, who have long-term professional experience as prosecutors in the Artsakh Prosecutor's Office and investigators in the Investigative Committee, be regulated: the right to a pension, what legal tools will be used to calculate their seniority, since such were made in the form of amending the law on the acquisition of the right to a pension for employees of the Artsakh Ministry of Internal Affairs, the State Enforcement Service, and the National Security Service and adopting a corresponding decision of the Government?
