The ECHR demanded from the RA government to clarify the circumstances of not providing necessary medical care to Gagik Khachatryan

Today, on October 18, 2024, another court hearing in the case of Gagik Khachatryan was held at the Anti-Corruption Court. During the session, lawyer Yerem Sargsyan petitioned the court again to allow Gagik Khachatryan to go abroad for treatment.

The statement of Gagik Khachatryan's defenders says: "The defender also informed the court that the European Court of Human Rights, on the basis of the complaint submitted by the advocacy group, demanded from the RA government to clarify the circumstance of not providing the necessary medical assistance to Gagik Khachatryan.

"Particularly, the court demanded to justify the first one: to what extent not allowing to leave for the purpose of surgery is consistent with the positive obligations of the state to guarantee the right to life. The ECHR also demanded to substantiate whether the failure to provide properly adapted conditions for persons with disabilities during the court session did not lead to humiliating and inhumane treatment of the person. We think this should be a sobering impulse for our state, which claims to once again violate the fundamental rights of human life and dignity. Last time, Gagik Khachatryan's restraining order was changed only because of the ECtHR decision. Now it turns out that our state is not going to stop the inhumane treatment until the ECHR registers a violation of the right," said lawyer Yerem Sargsyan.

Referring to the examinations appointed by the court, the defense attorney expressed his concern about the developed practice.

"The prosecutor once again demands to conduct an expert examination. Something that has already been done three times during this exam. If after three examinations the state does not have a "favorable" conclusion for it, then it is clear that depriving the person of medical care will not improve the person's condition on its own, the state will not receive that "favorable" conclusion. Therefore, it is not possible to go through this closed chain all the time," Yerem Sarsgyan said in his speech.

Let's remind that Gagik Khachatryan is accused of alleged abuse of official position, waste of property and official forgery, which he does not accept. Previously, Gagik Khachatryan, being in Germany, interrupted the post-operative treatment at the first call of the investigator, returned to Armenia and presented himself to the body conducting the proceedings. However, for two years now, the court has not allowed him to go abroad again for surgery, and the lawyers have appealed to the ECHR.
