A resident of Aragatsotn region, in the absence of legal grounds for exemption from military service, by using the diagnosis of another person's existing illness, avoided the winter draft of 2021, was recognized as unfit for service and was counted in the reserve force.
The Prosecutor's Office reports that in the criminal proceedings examined by the investigative committee, it was found that S.M., born in 2003, in December 2021, presented the Aragatsotn Marz Territorial Division (hereinafter referred to as the Ministry of Defense Territorial Division) of the Military Conscription Service of the Ministry of Defense as his diagnosed, certificate of the disease included in the list approved by the decision of the Government (in the criminal proceedings it was found that the certificate referred to another person who applied to a medical institution with a false passport).
In order to verify the authenticity of the disease mentioned in the document, the doctor-specialist of the military draft medical commission of the territorial unit of the Ministry of Defense referred SM to the same medical center for a medical examination, where the above-mentioned person again submitted a sample with a fake passport instead of SM.
Having received confirmation of the presence of the disease, according to the conclusion of the Central Medical Commission on January 27, 2022, S.M. was recognized as unfit for military service and enrolled in the reserve force.
A public criminal prosecution was initiated against S.M. under Article 327, Part 2, Clause 2 of the Criminal Code adopted on 18.04.2003 (evasion of military service by forgery or other means of deception).
On December 18, 2024, the public prosecutor confirmed the indictment regarding SM and handed it over to the court of first instance of Aragatsotn region together with the proceedings materials.
Notice: the person accused of a crime is considered innocent until his guilt is proven in accordance with the procedure established by the Code of Criminal Procedure by a legally binding court verdict.
