Court blocks Trump's 'birth tourism' ban



A federal district court in the US state of Maryland on Wednesday temporarily suspended the implementation of US President Donald Trump's order banning so-called birth tourism in the country.



According to this court decision, the Washington administration should temporarily refrain from taking measures to implement several key provisions of the order. It was signed by Trump in early August and is aimed at preventing the practice of foreign citizens coming to the United States specifically to have a child who receives American citizenship.



The court's decision is not final. The case is still under review. It was initiated in connection with the filing of a lawsuit by organizations protecting the rights of migrants.



The federal district court in Maryland found that the aforementioned order of the American leader contradicts the decision of the US Supreme Court. The country's highest court in June declared another Trump order unconstitutional, which also aimed to limit the granting of US citizenship by birth. The American leader signed the document after his inauguration on January 20, 2025. It instructed state agencies to refuse to grant citizenship to children born in the United States whose parents are there illegally, as well as in cases where the newborn's mother entered the country on a temporary basis, including under a visa-free regime with another country or on a study, work or tourist visa, and the father is not a US citizen or a person with permanent residence in the United States.



The Birthright Citizenship Amendment was passed in the United States after the Civil War (1861-1865), overturning the 1857 Supreme Court decision that denied citizenship to African Americans.
