The need to adopt a legal act
Adoption of the draft decision is conditioned by the need to ensure the continuity of social support to the families of the missing servicemen.
Current state of regulatory relations and existing problems
According to the RA government's decision of December 10, 2020 "On approving the support measure for the families of servicemen who went missing as a result of the military operations unleashed by Azerbaijan on September 27, 2020" N 2001-L (hereinafter referred to as the decision) it is planned until 2026. provision of social support in the form of a monthly cash payment to the serviceman's family in the amount of 300,000 AMD per month, including the month of June, but not more than until the missing serviceman is recognized as missing by court order. According to sub-point 3 of point 4 of the annex to the decision, the provision of monthly cash payments to the families of servicemen whose location is unknown is stopped if the monthly cash payments will be paid up to and including June 2026, as a result of which on 25.05.2026 As of 2026, the provision of support to the families of 20 servicemen considered missing, who do not yet have judicial acts to recognize them as missing, will be stopped. from July 1. Due to the existing realities, it is proposed to extend the support payment period up to and including September 2026.
The subject of regulation
According to the draft decision, it is planned to extend the period of providing support to the families of missing servicemen until 2026. including the month of September, and the RA Minister of Labor and Social Affairs is instructed to submit a proposal regarding the financing of the process.
The need for additional financial resources and expected changes in state budget revenues and expenditures.
In the event of the adoption of the draft decision, the financial calculation for providing support to the families of 20 missing servicemen for the months of July, August and September 2026 amounts to AMD 18,000,000. It is planned to attract the necessary funds through the redistribution of funds allocated to the RA Ministry of Labor and Social Affairs in the 2026 state budget.

The draft decision is related to the RA Government's 2021-2026. of the program "1.3 Defense sector. "Reforms of the Armed Forces" section, in the form of increasing the social protection of servicemen and their family members, being the focus of the Government's attention, increasing the guarantees of material and social security of servicemen, and gaining new momentum in the social and health programs of servicemen bearing the consequences of the war.
